English-Proficiency Rule: Why It’s Enforced Differently in Every State

The FMCSA has an English-proficiency rule that says every CDL driver must be able to speak and understand basic English. This includes talking with officers, reading road signs, and handling normal or emergency situations. The rule itself is federal — but how states enforce it is all over the place.

Some states barely check it. Some states enforce it hard. And drivers often don’t know what to expect until they’re already pulled over.

Here’s the clearest example of how different it can be:

  • California: For a long time, they didn’t enforce the English rule at all. Drivers rarely got cited for it.
  • Oklahoma: They enforce it strictly. If a driver can’t speak English during an inspection, both the driver and the employer can be fined $3,000 each.

That’s a huge difference and it affects real people on the road every day.

For drivers, this means you might pass through one state with no issues and then get hit with a major violation in another. For employers, it means you need to know where your drivers are running and what the local rules look like.
