The Follow-Up Evaluation: The Final Gate Before Return-to-Duty

In the DOT return-to-duty process, the follow-up evaluation is more than just a final check-in—it’s the official green light that determines whether an employee can safely return to safety-sensitive duties. If you're a Substance Abuse Professional (SAP), treatment provider, or employer, here's what you need to know about this critical step.

What Is the Follow-Up Evaluation?

The follow-up evaluation is the SAP’s clinical determination of whether the employee has successfully complied with the treatment or education recommendations made during the initial evaluation.

This evaluation is:

  1. Required by DOT regulations
  2. The trigger for the employer to conduct a return-to-duty (RTD) test
  3. The final step before an employee can resume safety-sensitive work

When Can the Employer Conduct the RTD Test?

Only after the SAP has completed the follow-up evaluation and issued a written report stating that the employee has complied. In most DOT modes, the employer must receive this report before scheduling the RTD test.

The only exception is Federal Motor Carrier Safety Administration (FMCSA), where the SAP enters the eligibility date into the Clearinghouse, and that entry allows the employer to proceed with testing.

What Must the Follow-Up Evaluation Include?

DOT regulations require that the follow-up evaluation be:

  1. Face-to-face (either in person or via a secure virtual platform)
  2. Clinically based, using a valid and reliable assessment tool

The SAP must also:

  1. Indicate whether the evaluation was in person or virtual
  2. Include input from the treatment provider
  3. Review the discharge summary, treatment progress, and relapse prevention plan

This information helps the SAP make informed decisions about:

  1. Whether the employee has complied
  2. What kind of continuing care is needed
  3. The follow-up testing plan the employer must implement

Why This Step Matters

Without a completed follow-up evaluation:

  1. The employer cannot legally conduct an RTD test
  2. The employee cannot return to safety-sensitive duties
  3. The SAP cannot finalize the case

This step ensures that the employee is truly ready—clinically and behaviorally—to return to work in a role that impacts public safety.

The DOT language is clear: the follow-up evaluation is about compliance, not just participation. SAPs must gather the right information, use sound clinical judgment, and document everything thoroughly. When it comes to safety-sensitive work, we don’t guess—we assess.
