If you’re a commercial driver who’s lost a job due to a DOT drug or alcohol violation, you know how hard it can be to get back on the road. One of the biggest hurdles? Taking a return-to-duty (RTD) test when you don’t have an employer to send you for one.
Well, there’s now a legal workaround—and it’s a game-changer.
What’s the Workaround?
Thanks to pressure from drivers and their representatives in Congress, the Federal Motor Carrier Safety Administration (FMCSA) created a workaround that allows drivers to take a return-to-duty test without being employed.
Here’s how it works:
- A driver can register with a C/TPA (Consortium/Third-Party Administrator) just to take the RTD test.
- If the test result is negative, the C/TPA will report the date to the Clearinghouse, clearing the violation.
- This allows the driver to start applying for new jobs.
Step-by-Step: How to Use the Workaround
- Register in the Clearinghouse as an owner-operator—even if you’re not one.
- You’ll need to register as both the owner and the driver.
- When it asks for a DOT number, just skip it. You don’t need one to complete the process.
- Find a C/TPA willing to help.
- Not all C/TPAs will do this, so you may need to call around.
- You’ll have to pay for both the C/TPA membership and the RTD test.
- Take the RTD test through the C/TPA.
- If it’s negative, the C/TPA will update the Clearinghouse, clearing your record.
- Apply for jobs once your record is cleared.
- Re-register in the Clearinghouse as a regular driver (not an owner-operator) after you’re hired.
Common Pitfalls to Avoid
- Skipping the re-registration step after getting a job can cause confusion and delays.
- Entering a fake DOT number—don’t do it. Just leave it blank and move on.
- Assuming all C/TPAs offer this—they don’t. Be prepared to call around and confirm.
Why This Matters
Before this workaround, drivers were stuck in limbo—unable to take the RTD test without an employer, and unable to get hired without a negative RTD test. Now, there’s a legitimate path forward, even if it’s not perfect.
This process is officially documented by FMCSA, meaning it’s no longer an informal workaround—it’s a real, legal option for drivers working to get back behind the wheel.
